Encircle Benefits Rewards Program – Terms & Conditions

Welcome,

Encircle Benefits, LLC, doing business as Encircle Benefits (hereinafter referred to as the “Company,” “we,” “us,” or “our”), operates the Encircle Benefits Rewards Program (the “Program”) to provide eligible members with access to discounts, offers, rewards, and other incentives. By enrolling in the Program or participating in any Program activities, you (“Member” or “you”) acknowledge and agree to be bound by these Terms and Conditions, as well as any modifications thereto, and to comply with all applicable laws.

Program Management

The Program is administered Encircle Benefits, LLC (hereinafter “Administrator”) under contract with the Company. Participation in the Program constitutes acceptance of these Terms and Conditions and any rules, policies, or updates published on the Program website  https://encirclebenefits.com/  (the “Website”). All access to and use of the Website and Program is undertaken at the Member’s sole risk.

Eligibility

  1. Participation in the Program is open to individuals who are:
    • Age 18 or older;
    • Legal residents of USA; and
    • Able to maintain a valid account in good standing with the Company.
  2. Membership in the Program is voluntary and limited to natural persons unless expressly approved by the Company. Corporations, professional organizations, or other entities are not eligible to enroll unless authorized.
  3. Membership may be denied or revoked at the Company’s sole discretion. By enrolling, you acknowledge your understanding and agreement to abide by these Terms and Conditions and accept all decisions by the Company and Administrator as final.

Program Changes

  1. The Company reserves the right to modify, suspend, restrict, or terminate any Program benefits, rewards, or features at any time, with or without notice.
  2. Any changes to points accrual, redemption, or Program rules may affect your ability to use previously earned points.
  3. Continued participation in the Program constitutes acceptance of any updated Terms and Conditions.

Enrollment and Opt-Out

  1. Enrollment requires creation of a username and password on the Website, and may require providing additional contact information.
  2. Members may opt out of the Program at any time via the Website. Opting out will result in ineligibility for Program rewards, offers, or points.

Earning Encircle Points

  1. Points are awarded only after the Member account is confirmed as enrolled in the Program.
  2. Points may be earned for activities as determined solely by the Company or Administrator.
  3. Bonus points, promotions, or special offers may be offered periodically at the sole discretion of the Company.
  4. The Company reserves the right to adjust point totals, eligibility, or availability for accuracy, compliance, or appreciation of specific Members.

Points Restrictions

  1. Points have no cash value and may not be redeemed for cash or transferred, sold, or bartered.
  2. Points remain property of the Company. Suspension or termination of the Program will void any unredeemed points.
  3. Points may only be redeemed as specified in the Program Catalog. Use is limited to one-time redemption per item or offer.

Redeeming Points

  1. Points may be redeemed for rewards in the Program Catalog, which may include discounts, merchandise, experiences, or other offers.
  2. Availability of rewards is subject to change and may be limited. The Company reserves the right to substitute rewards of equal or greater value.
  3. Additional restrictions may apply to specific rewards, which will be clearly noted in the Program Catalog.

Prize Promotions and Sweepstakes

  1. From time to time, the Company may sponsor sweepstakes, contests, or special promotions as additional opportunities to earn points or prizes (“Promotions”).
  2. Official rules for each Promotion, including entry, eligibility, and winner determination, will be published on the Program Website.
  3. No purchase is necessary to enter any Promotion, and purchase does not increase chances of winning.
  4. Winners are responsible for all applicable taxes and expenses associated with prizes.

Disqualification

The Company may disqualify Members or entries if:

  1. Accounts are not in good standing;
  2. Fraud, misrepresentation, or abuse is suspected;
  3. Any Terms and Conditions are violated.

Disqualification may include suspension, forfeiture of points, ineligibility for Promotions, or termination of Program participation.

Privacy and Unauthorized Use

  1. Members are responsible for providing accurate contact information and notifying the Company of any changes.
  2. The Company is not liable for unauthorized access to accounts or misuse of points.
  3. Collection, use, and disclosure of personal information are governed by the Company’s Privacy Policy [INSERT PRIVACY POLICY URL].

No Discrimination

Participation and access to Program rewards or points will not be restricted based on race, color, national origin, gender, disability, or any protected class under applicable law.

Disputes and Governing Law

  1. Any disputes arising from the Program, points, or rewards will be resolved individually and exclusively in the courts of U.S.A.
  2. Applicable law: U.S.A. law governs these Terms and Conditions without regard to conflict of law principles.
  3. Members waive rights to class actions or punitive damages, except for actual out-of-pocket expenses.

Limitation of Liability

By participating, Members agree to release the Company, Administrator, and affiliates from any liability, including:

  • Participation in the Program;
  • Use, possession, or misuse of points or rewards;
  • Technical failures or unauthorized access;
  • Any errors in the Program administration.

Enforceability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in effect.

Sweepstakes & Promotions – Official Rules

  1. Eligibility: Must be a Program Member in good standing and meet age and residency requirements.
  2. Entry: One entry per eligible Member per day unless otherwise specified.
  3. Winner Selection: Winners selected by random drawing, as determined by the Company or Administrator.
  4. Notification: Winners will be notified via the contact information on file.
  5. Taxes: Winners are responsible for all applicable taxes and fees.
  6. Prize Substitution: Company may substitute prizes of equal or greater value if necessary.
  7. Odds: Depend on the number of eligible entries.

Security

Reasonable measures are taken to protect Member information. Members are responsible for safeguarding login credentials and must log out after each session.
